Komirka Terms of Service
These Terms of Service ("Terms") govern your use of the Komirka iOS app, backend services, account features, music-provider connections, backups, exports, subscriptions, support channels, and related services (together, "Komirka" or the "Service").
By creating an account, using Komirka, connecting Apple Music or Spotify, starting a backup, exporting data, or buying a Komirka Pro subscription, you agree to these Terms. If you do not agree, do not use Komirka.

1. What Komirka Does
Komirka helps you connect Apple Music and/or Spotify, back up music library metadata, view backup history, export backup files, and manage a monthly or yearly Komirka Pro subscription.
Komirka stores and processes music-library metadata such as song, album, artist, playlist, playlist-track, provider identifier, artwork URL/template, raw provider attributes, backup status, timestamps, counts, duration, and error information. Komirka does not store or back up audio files.
Komirka depends on Apple Music, Spotify, Apple App Store, RevenueCat, PostHog, backend infrastructure, and other service providers. Provider outages, API changes, permission changes, account changes, token expiration, rate limits, regional limits, deleted playlists, private or inaccessible content, or other issues can prevent Komirka from connecting, backing up, exporting, or displaying data.
2. Eligibility
You must be at least 13 years old to use Komirka. If you are under the age of majority where you live, you may use Komirka only with permission from a parent or legal guardian where required by law.
Do not create an account or use Komirka if you are not allowed to use the Service under applicable law, these Terms, Apple terms, Spotify terms, or other provider terms that apply to your use.
3. Accounts and Security
Komirka uses first-party email and password accounts through Komirka's backend. Komirka does not currently offer social login.
You agree to provide accurate account information, keep your credentials confidential, and promptly tell us if you believe your account has been accessed without permission. You are responsible for activity under your account unless applicable law says otherwise.
We may refuse, suspend, or terminate accounts that violate these Terms, create security risk, abuse the Service, infringe rights, bypass limits, or are required to be blocked by law or provider requirements.
4. Apple Music and Spotify Connections
Apple Music and Spotify connections require your authorization. By connecting a provider, you authorize Komirka to access, store, refresh, and process the provider data needed to provide backups, history, reconnect notices, scheduled Pro backups, and exports.
You are responsible for complying with Apple Music, Spotify, and related provider terms. Komirka is not endorsed by, sponsored by, or affiliated with Apple, Apple Music, Spotify, RevenueCat, or PostHog. Provider names, marks, content, and services belong to their respective owners.
You may disconnect Apple Music or Spotify in Komirka. Disconnecting removes stored provider tokens from Komirka and stops future provider access unless you reconnect. Disconnecting a provider does not delete existing backups by itself. To delete account-associated backend data, delete your Komirka account or contact privacy@komirka.me as described in the Privacy Policy.
5. Backups, Limits, and Exports
Komirka backs up music-library metadata from supported provider endpoints. Komirka does not guarantee that every song, album, playlist, track, artwork URL, provider attribute, or provider-side change will be captured, available, accurate, or exportable.
Manual backup limits are:
- Free accounts: 3 manual backups per provider per UTC calendar month.
- Komirka Pro accounts: 30 manual backups per provider per UTC calendar month.
Only one manual backup per provider may run at a time. Scheduled backups are available to eligible Komirka Pro users with connected provider tokens, but scheduled backups are not guaranteed to run continuously or at an exact time.
CSV/ZIP exports are available for Komirka Pro users and only for successful backup snapshots. Export files may contain the music metadata described in the Privacy Policy. After you download or share an export, you are responsible for protecting that file.
Komirka currently keeps up to 100 successful backup snapshots and up to 50 failed backup snapshots per provider and user. Older snapshots may be deleted during retention cleanup, and queued or running snapshots may be marked failed if stale.
6. Komirka Pro Subscriptions
Komirka Pro is available as monthly and yearly auto-renewable subscriptions purchased through Apple's App Store in-app purchase system. RevenueCat helps Komirka manage subscription entitlements and reconcile subscription status.
The purchase screen, App Store purchase flow, and Apple account settings show the subscription product, price, renewal period, billing details, trial or promotional terms if any, and cancellation options. Your subscription renews automatically unless canceled according to Apple's cancellation rules. Apple handles payment processing, billing, cancellation, renewal, taxes, refunds, and payment method issues.
You can manage or cancel an App Store subscription in your Apple ID subscription settings. Deleting your Komirka account, deleting the app, disconnecting Apple Music or Spotify, or contacting Komirka does not cancel your App Store subscription.
Komirka Pro features may include higher manual backup limits, scheduled backups, and CSV/ZIP exports. Komirka may add, remove, or change Pro features over time, subject to applicable law and App Store requirements. If Komirka cannot verify your subscription because Apple, RevenueCat, your account, or Komirka's backend is unavailable, Pro features may be temporarily unavailable until verification succeeds.
7. Privacy, GDPR, and CCPA/CPRA
Komirka's Privacy Policy explains what personal data Komirka collects, how it is used, where it is stored or shared, how long it is kept, and how you can exercise privacy rights. This includes information about GDPR, UK GDPR, CCPA/CPRA, access, deletion, correction, portability, objection, consent withdrawal, no sale/share for targeted advertising, analytics, international transfers, and provider data.
The Privacy Policy is available at https://komirka.me/privacy. If there is a conflict between these Terms and the Privacy Policy about personal data processing, the Privacy Policy controls for that data-processing issue.
8. Account Deletion
You can delete your Komirka account in the app. Account deletion is intended to permanently delete your account, backend sessions, provider tokens, push token, linked RevenueCat webhook rows, and stored Apple Music/Spotify backup snapshots and their items from Komirka's backend database, subject to lawful exceptions and backup/infrastructure propagation described in the Privacy Policy.
Account deletion does not cancel your App Store subscription. You must cancel any active subscription through Apple.
9. Acceptable Use
You agree not to:
- use Komirka for unlawful, harmful, fraudulent, abusive, or infringing activity;
- attempt to access another user's account, provider tokens, backups, exports, or data;
- bypass authentication, rate limits, subscription checks, provider permissions, or technical restrictions;
- scrape, overload, attack, probe, reverse engineer, or disrupt Komirka, except where applicable law gives you a non-waivable right to do so;
- use Apple Music or Spotify data in a way that violates provider terms or permissions;
- sell, sublicense, redistribute, or commercially exploit provider content or provider data except where you have all required rights;
- use Komirka to create spam, malware, unauthorized automation, or security risk;
- misrepresent your identity, authorization, affiliation, or rights.
We may investigate suspected violations and may suspend or terminate access where reasonably necessary to protect Komirka, users, providers, infrastructure, legal compliance, or third-party rights.
10. Intellectual Property
Komirka, including its app design, backend services, software, branding, and related materials, is owned by Andrii Minikh or licensed to Komirka. These Terms do not transfer ownership of Komirka to you.
You retain any rights you have in your account information and provider data. You grant Komirka the limited rights needed to operate the Service, including storing, processing, displaying, backing up, exporting, securing, troubleshooting, and improving the Service as described in these Terms and the Privacy Policy.
11. App Store License
The Komirka iOS app is distributed through Apple's App Store. For v1, Komirka relies on Apple's standard Licensed Application End User License Agreement unless a custom EULA is later provided through App Store Connect. Apple may enforce the App Store license terms as a third-party beneficiary where applicable.
These Terms govern Komirka accounts, backend services, subscriptions, backups, exports, provider connections, and related support. Apple terms also apply to your App Store download, in-app purchases, device usage, and Apple services.
12. Service Changes and Availability
Komirka may change, suspend, limit, or discontinue features when needed for security, maintenance, legal compliance, provider requirements, App Store requirements, infrastructure changes, product changes, or abuse prevention.
Komirka is provided on an "as is" and "as available" basis. We do not promise that Komirka will be uninterrupted, error-free, always secure, always compatible with provider APIs, or that backups or exports will always be complete, current, accurate, or recoverable.
13. Disclaimers and Liability Limits
To the maximum extent permitted by applicable law, Komirka disclaims all warranties and conditions not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
To the maximum extent permitted by applicable law, Komirka and its operator will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss, corruption, inaccuracy, unavailability, or deletion of data, provider content, backups, exports, subscriptions, or account access.
Nothing in these Terms excludes or limits liability or consumer rights that cannot be excluded or limited under applicable law, including mandatory EU or Polish consumer protection rights.
14. Termination
You may stop using Komirka at any time. You may delete your account in the app.
We may suspend or terminate your access if you violate these Terms, create risk or liability, abuse the Service, fail subscription verification for Pro-only features, or if we must do so to comply with law, provider requirements, App Store requirements, or security needs.
After termination or account deletion, some provisions of these Terms will continue where reasonably necessary, including provisions about privacy requests, subscription cancellation through Apple, intellectual property, disclaimers, liability limits, governing law, and disputes.
15. Changes to These Terms
We may update these Terms when Komirka changes, when providers or laws change, or when we need to clarify our practices. The "Last updated" date shows when these Terms were last revised.
If changes are material, we will provide notice as required by law. Your continued use of Komirka after updated Terms become effective means you accept the updated Terms, unless applicable law requires a different process.
16. Governing Law and Disputes
These Terms are governed by the laws of Poland, without excluding mandatory consumer protections that apply in your country of residence.
If you are a consumer in the European Union, you may have the right to bring claims in your local courts or use other mandatory consumer dispute mechanisms. Nothing in these Terms limits rights that cannot be waived under applicable law.
